This privacy policy applies to all personal information collected by Thrice The Chaos (we, us or our), and outlines our ongoing obligations to you in respect of how we manage your Personal Information via our website, which is located at www.thricethechaos.com.au (our website).

This Privacy Policy also outlines your rights under the General Data Protection Regulation (GDPR).
Please note that this Privacy Policy forms part of the Terms of Use document, which is displayed at the footer of each page of our website. We have also adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

1.    What is Personal Information and why we collect it?

 

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect includes names, addresses, email addresses, phone numbers.

This Personal Information is obtained in many ways including interviews, correspondence, by telephone, by email, via our website www.ThriceTheChaos.com.au, from your website, from media and publications, from other publicly available sources, from cookies, and from third parties. We don’t guarantee website links or the policy of authorised third parties.

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information, we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Wherever possible, you can elect to remain anonymous, or use a pseudonym, in interacting with us (for example, when making an enquiry).

The Privacy Act 1998 (Cth) (Privacy Act) defines types of information, including Personal Information and Sensitive Information.

individual who is reasonably identifiable:

a)    whether the information or opinion is true or not; and

b)    whether the information or opinion is recorded in a material form or not.

 

If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as “Personal Information” and will not be subject to this privacy

policy.

Sensitive Information is defined in the Privacy Act as including information or opinion about

such things as an individual's racial or ethnic origin, political opinions, membership of a political

association, religious or philosophical beliefs, membership of a trade union or other professional

body, criminal record or health information.

Sensitive Information will be used by us only:

a)    for the primary purpose for which it was obtained;

b)    for a secondary purpose that is directly related to the primary purpose; and

c)    with your consent or where required or authorised by law.

 

 

3.    How we collect your Personal Information

Direct interactions - you may provide us with your personal information by filling in forms or by corresponding with us, in various ways.

 

a)    We may collect Personal Information from you whenever you input such information into our website, related app or provide it to us in any other way

b)    We generally don’t collect Sensitive Information, but if and when we do, we will comply with the preceding paragraph.

c)    Automated technologies or interactions - we may, as you interact with our website, automatically collect information about your equipment, browsing actions and patterns. As a general rule, however, it is not possible to identify you personally from our use of cookies.

d)    Where reasonable and practicable we collect your Personal Information from you only. However, sometimes we may be given information from a third party, in cases like this we will take steps to make you aware of the information that was provided by a third party.

 

 

4.    Use and Disclosure of Information

 

a)    We collect Personal Information to provide you with the best service experience possible on the website and to keep in touch with you about developments in our business. When we hold your personal information, it will be used for the following primary purposes:

  • to ensure the proper functioning of our website;

  • to ensure the proper functioning of our business; and

  • to assist us with our auditing, marketing, planning, billing, product development and research requirements.

b)    We customarily only disclose Personal Information to our service providers who assist us in operating the website. When we no longer require your Personal Information for the purpose for which we obtained in, we will take reasonable steps to destroy and anonymise or de-identify it. Most of the Personal Information that is stored in our client files and records will be kept for a minimum of 7 years to fulfill our record keeping obligations.

However, you use our website at your own risk and we accept no responsibility, whether we are deemed to have been negligent or not, in the event of a security that affects your privacy.

Thrice The Chaos will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information, we may require identification from you before releasing the requested information.

 

 

7.    Maintaining the Quality of your Personal Information

 

It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

 

 

8.    Overseas transfer

 

Your Personal Information may be transferred overseas or stored overseas for a variety of

reasons. It is not possible to identify each and every country to which your Personal Information may be sent. If your Personal Information is sent to a recipient in a country with data protection laws which are at least substantially similar to the Australian Privacy Principles, and where there are mechanisms available to you to enforce protection of your Personal Information under that overseas law, we will not be liable for a breach of the Australian Privacy Principles if your Personal Information is mishandled in that jurisdiction. Privacy principles under the General Data Protection Regulation (GDPR).

 

The GDPR sets out six principles relating to the processing of personal data:

  • Integrity and confidentiality

 

The GDPR sets out numerous grounds upon which we may lawfully collect and process your personal information, including:

The fact that you may be located in Europe does not, however, on its own entitle you to protection under the European Union GDPR. Our website does not specifically target customers located in the European Union and we do not monitor the behaviour of individuals in the European Union, and accordingly the GDPR does not apply.
